The document that keeps you out of court

Drafting and updating the Risk Assessment Document under D.Lgs. 81/08: specific risks (chemical, biological, noise, vibrations, manual handling, work-related stress), operating procedures, associated training.

Regulatory references: D.Lgs. 81/2008 artt. 17, 28, 29 · D.Lgs. 106/2009
● In the field

"The DVR isn't a PDF: it's the document a judge opens first if someone gets hurt at work."

What it is

The DVR (Risk Assessment Document) is the employer's first non-delegable duty. It identifies all risks in the workplace, assesses severity and probability, and defines prevention and protection measures.

No "standard" DVR exists: each company has its own risk map. A carpentry, a restaurant, an office and a construction site have completely different DVRs. The document must be dated, signed by employer and RSPP, countersigned by company doctor and RLS (Workers' Safety Representative).

Reference regulations

• D.Lgs. 81/08 (Safety Consolidated Act), particularly arts. 17, 28, 29: minimum content, assessment criteria, updating.
• D.Lgs. 106/2009 corrective decree.
• Technical annexes for specific risks: chemical, biological, noise, vibrations, manual handling, work-related stress (EU Framework Agreement 2004).

Penalties for omission:
• No DVR: 3-6 months arrest or €2,500-6,400 fine for employer (PERSONALLY).
• Incomplete DVR: €1,500-4,500.
• Serious injury without DVR: criminal risk under art. 590 c.p. (negligent injury).

Who needs it and when

For all companies with at least one employed worker, including family staff, in any sector.

Mandatory update when:
• A new machine or chemical is introduced.
• A production process changes.
• A significant injury occurs (sick days > 3).
• Work organisation changes (shifts, duties, new departments).
• Premises are moved or expanded.
• New applicable regulation issued.

Without events: update recommended every 3 years, mandatory in many cases.
